These Terms and Conditions apply to all orders submitted by the customer (hereinafter “the Customer”) to ByHey (hereinafter “we” or “ByHey”) through the website or mobile site. By using byhey.store and/or placing an order, the Customer agrees to comply with the following Terms and Conditions (the “Terms”). Please read and fully understand the Terms before placing an order.
Only individuals (not companies or corporations) aged 18 or older, who are not under guardianship, subject to VAT, and have a delivery address in Italy and Europe, can place an order.
The inclusion of any product or service on byhey.store at a particular time does not imply or guarantee that such products or services will be available at all times. ByHey reserves the right to suspend any product at any time.
ByHey reserves the right to amend the Terms at any time and without notice. The version of the Terms applied to the Customer’s order is the one available on byhey.store at the time of placing the order.
ByHey aims to provide the best possible online shopping experience. To achieve this, we must ensure that our services function perfectly. The customer declares to understand and agree not to (i) send, transmit, redistribute, upload, or promote any communication or content that may harm or negatively impact our business, products, or services; (ii) act in a way or use any device that limits, compromises, interferes, or inhibits any other user from using or enjoying the site byhey.store, or that impacts the site’s security; or (iii) use any device or attempt to use any engine, software, equipment, agent, script, or other device or mechanism (including but not limited to spiders, bots, crawlers, avatars, or intelligent agents) to navigate or search within the site, or to copy content from the site. ByHey reserves the right to immediately prohibit access to the site and close the account of any user who violates these provisions or any other provision of these Terms and Conditions.
Changes to Prices and Shipping Costs
The prices published on byhey.store include the current VAT but exclude shipping costs.
The delivery costs for each order will be the same, regardless of the size or weight of the parcel. The cost for each delivery method is clearly indicated during the order completion process. The cost for standard shipping is:
Italy – €6.50
Europe – €14
If ByHey is unable to deliver the entire order and multiple shipments are required, the Customer will not be charged any additional amount for the additional shipments. Prices may vary between store, catalog, and online.

After submitting the order, if the Customer has provided an email address, they will receive a confirmation email. If for any reason ByHey is unable to fulfill the order, the Customer will be informed as soon as possible. If ByHey has already received payment for such an order, the amount will be refunded using the same method chosen by the Customer for the payment. If, for any reason, different arrangements are necessary, ByHey will inform the Customer and request them to contact ByHey Customer Service for the refund.
ByHey exercises the utmost diligence in accepting and processing orders and will do its best to deliver the orders to a residential address or another address in Italy and Europe, according to the selected shipping option by the Customer.
ByHey will make every effort to deliver orders as quickly as possible and in the order they were issued. ByHey’s goal is to deliver orders within 2 to 3 business days after order confirmation. Despite the goal of delivering within the indicated range, delivery may take longer due to unforeseen circumstances. In case the delivery is delayed by more than 30 days, the Customer may cancel the order.
Before issuing the order, ByHey will inform the Customer of the details of the expected shipment. After sending the order, if the Customer has provided an email address, they will receive a confirmation email containing the details of the expected shipment.

If the order does not arrive by the specified date, please contact ByHey Customer Service.
Shipping costs are 6,50€ for Italy and 14€ for shipments to Europe. To ensure cheaper and faster rates, we collaborate with WeLoco of Caramagna Piemonte, which can appear as the shipper on delivered packages.
Barring unforeseen circumstances, ByHey Shop will process your order within 5 business days of receiving it, once payment has been made. During certain times of the year, there may be a slight extension of waiting time due to supplier availability.
Exchange and returns policy
ByHey’s products are made to order and without stock, which is precisely why we do not accept product exchange requests for size or color changes. We encourage you to carefully review our size charts to verify the correct size, possibly comparing the measurements to a similar garment you own that fits you well. You can find the charts by clicking on the link located below the size selection window of each product. We have taken great care in creating the charts for each model, ensuring measurements are aligned with European fit standards.
In case of defective products, a replacement will be made instead, at ByHey’s expense. We kindly ask you to send us photographs clearly showing the defect found.
Changes to Orders
Payment before Delivery
Credit or Debit Card
You can enter the payment details at the time of placing the order, using a valid credit or debit card (VISA, Mastercard, or American Express). The amount to be paid will be immediately reserved on the card but will not be charged until the items are shipped. ByHey reserves the right to check the validity of the credit or debit card, the credit status in relation to the order value, and the accuracy of the buyer’s address. ByHey may refuse the order based on the results of such checks.
If you choose to pay with PayPal, ByHey reserves the right to check the validity of the PayPal account, verify that there are sufficient funds to cover the purchase, and confirm the accuracy of the billing address. The amount to be paid will be immediately reserved in the PayPal account but will not be charged until the items leave the warehouse. ByHey reserves the right to refuse any order.
You will receive the legally valid invoice in the shipment confirmation email.
None of the provisions herein limit or exclude ByHey’s liability in any case where an exclusion or limitation of liability would be contrary to the law.
ByHey accepts liability for death or personal injury caused by its negligence, or that of its employees or agents. ByHey does not exclude its liability for fraudulent misrepresentation by us, our employees, or agents. In case of a breach of these Terms, ByHey shall be liable only for losses that are a reasonable and foreseeable consequence of such breach.
ByHey shall not be liable for indirect losses that are a side effect of the main loss or damage, such as loss of profits or opportunities; nor for the inability to deliver goods or fulfill other obligations stipulated by these terms, when such failure is attributable to an event beyond our reasonable control, including but not limited to fires, floods, storms, riots, civil disturbances, war, nuclear accidents, and terrorist activities.
The maximum liability of ByHey for any loss or damage related to the order placed on byhey.store shall be limited to the total price of the order.
If you have a problem with a product you purchased from ByHey online, and you have not resolved the issue with ByHey, you can submit your complaint to the EU’s Online Dispute Resolution platform (the “ODR platform”).
The ODR platform offers consumers and professionals within the EU the opportunity to reach an out-of-court settlement for complaints related to online purchases. The website is designed to be interactive and easy to understand, available in all official EU languages, and free of charge. By using the ODR platform, the consumer and the professional can turn to a competent body and then try to find a solution to the dispute. The ODR platform is available here: http://ec.europa.eu/odr.
Colors and Sizes
ByHey makes every effort to accurately display the features of our products, including composition and colors. The displayed colors depend on the system used on the Customer’s computer; ByHey cannot guarantee that the Customer’s computer will accurately reproduce the colors.
The measurements of the garments indicated on byhey.store are approximate values to help you better understand the fit and size of that specific item and do not represent a guarantee of the actual measurement of the items you will receive. The actual measurements of a garment may vary depending on the material used for production.
If the purchased goods have defects, ByHey will comply with all applicable warranty regulations. If the Customer wishes to make a complaint regarding an obvious defect in the material or manufacturing of the goods supplied by us, including damages resulting from transportation, the Customer is kindly requested to notify us at the email address firstname.lastname@example.org.
ByHey reserves the right to assign any payment credit due and arising following the delivery of goods, including any debt due to third parties.
If any part of these Terms is or becomes null or illegal or unenforceable under the law, it will not in any way affect the validity, applicability, or legitimacy of the remaining Terms.
Ownership of Rights
All intellectual property rights, such as trademarks and copyrights on byhey.store, belong to ByHey – Oscar Cauda. Any use of byhey.store or its contents, including copying or saving such content in whole or in part for purposes other than personal and non-commercial use, is prohibited without the permission of ByHey.
